Laws may be divided into substantive laws and procedural laws. The laws by which rights, duties and liabilities are defined are called substantive laws. The purpose of the substantive laws is to deal with the principles creating or destroying rights, duties and liabilities. The laws of procedure, on the other hand, prescribe the mode by which the application of the substantive law is regulated.
Legal writing is a type of technical writing used by lawyers, judges, legislators and others in law to express legal analysis and legal rights and duties. ‘Legal drafting’ is the crystallization and expression in the definitive form of a legal right, privilege, function, duty or status and creates binding legal text. It is the development and preparation of legal instruments such as constitutions, statutes, regulations, ordinances, contracts, wills conveyances, indentures, trusts and leases etc., A ‘pleading’ is a formal written statement filed with a court by parties in a civil action, other than a motion. By stating what claims and defenses are at issue, pleadings establish the issues to be decided by the court. ‘Conveyance’ is an act of conveyancing or transferring any property whether movable or immovable from one person to another permitted by customs, conventions, and law within the legal structure of the country. A system of conveyancing is usually designed to ensure that the buyer secures title to the land together with all the rights that run with the land, and is notified of any restrictions in advance of purchase.
The subject drafting, pleading and conveyancing has been included in the syllabi with a view to equip the students with legal drafting abilities, legal framework pertaining to appearances before various tribunals, quasi-judicial bodies, courts and the basic understanding of the principles of pleading. Hence, the topics in this book are so designed to provide practical orientation and develop necessary acumenship in legal writing and drafting legal documents.
This book covers the aforesaid topics of drafting, pleading and conveyancing and will be useful to the students of the 3/5 year law degree course to enable them to get a broad understanding of the topics that would be covered under the revised syllabi with effect from the academic year 2020-2021. This paper presupposes knowledge of substantive law and warrants continuous update in terms of substantive and procedural laws as well as latest judicial pronouncements. Moreover, drafting of petitions, deeds, and documents is an art and even acquiring working knowledge in the relevant field demands application of skills of higher order. Therefore, the students are advised not only to master the principles and applications of drafting and pleadings, but also to keep themselves abreast of latest developments by regularly resorting to reading of law journals and at least one of the leading newspapers.
